I was dragged out of the WV House Chambers because I listed Delegates’ campaign donors.

As I tried to give my remarks at the public hearing this morning on HB4268 in defense of our constitutional property rights, I got dragged out of House chambers.

Why? Because I was listing out who has been donating to Delegates on the Judiciary Committee.

This is, of course, public information.

Allow me to point out that if Delegates genuinely think that my talking about who their campaign donors are—and how much they’re receiving from corporate lobbyists/corporate PACs—is an ad hominem attack… then they should be refusing those donations.

Yeah, refuse any donation that, if someone mentions it, makes you feel personally attacked.

Because that’s not an attack. That’s guilt. And you SHOULD be feeling that. Let that guilt about who you’re really working for inform your votes; don’t let the corporate money do it.

I veered from the prepared remarks almost immediately… because I followed Woody Thrasher, who predictably said, more or less, “But we have to let corporations steal from mineral owners, because JOBS!”

(I paraphrase… but not that much.)

Prepared Remarks

I’m Lissa Lucas from beautiful Ritchie County, WV, right in the front lines of the Marcellus. I’m a mineral owner. And I’m here to tell you that ALL of us, no matter our party, want our property rights protected. The attack on property rights is an assault on rural people, and it goes against both party platforms.
While lobbyists have the money to buy your time at fancy gatherings like the Wine and Whisky gala at the Marriott on Wednesday—members of the public have been allotted just about 2 minutes each to make the case for our rights, so I’ll just have time to talk about four delegates.

CHARLOTTE LANE – Kanawha County (D35) $9,500/$48,770 about 20%

1. Harshbarger – He works for Dominion, and donated $2k to his campaign. If you count that, he got 59% of his campaign cash from energy interests $5500/$9300 –

5. FREDRIK ERIC NELSON JR CAMPAIGN CMTE $500.00 (Delegate Nelson’s top donors are the same top donors as everyone I’ve spoken about here, and in fact he received $23K from anti-property rights corporations like Dominion, EQT, AEP.)

Delegates you cannot, without the appearance of impropriety—and likely without actual impropriety—vote for this bill.

For those watching online or in the gallery, if your delegate votes to give away your rights to their corporate donors, you should get behind a candidate who’ll work for YOU, rather than someone who is getting paid to hand over your property rights to corporations. Save for Del Harshbarger, there are Republicans challenging them in the primary, and a Democrat who will challenge the winner, so in most cases there’s someone no matter your political persuasion.

Full disclosure: There is a Democratic challenger for Harshbarger—that would be me. But I’m here to talk about the sale of our constitutional rights, not to campaign. So let’s move on to Delegate Armstead.

Armstead is not a member of this committee, but he’s the guy who makes committee assignments for his party. His donors include the usual suspects—AEP, EQT, Dominion, FirstEnergy, etc. He got nearly $20K ($19,550) from energy donors, about 21% of his total. He seated on this committee everyone I’ve just talked about, and people I haven’t been allotted the time to talk about. Yeah, he’s working for those same donors, too.
Delegates, voting to help the corporations that bought you is moral turpitude. And if y’all vote to enable Big Government to tell tax paying citizens what we can do with our own durn property, you can bet there will be people like me coming out of the woodwork to challenge you… and to make sure you either represent the people, or you get the hell out.

    While i fully support the move this lady made. Please watch the video its 2:30 long. And then note that this public hearing is to comment on the bill

    In all frames. Listing names and then saying who pays them and how much does not address the bill itself and is an individual remark, outside the rules of the hearing.

    The proper method to bring this issue to light while staying on form of the bill is this

    X of the voting members for this bill were paid Y amount by Z corporations. Full lists and breakdowns are public information.

    This bill is written in the interest of Z corporations. It benefits them by (List benefits) and harms normal people by (list harm’s) if this bill is passed its proof that X legislature members are bought and paid for and dont represent public opinion.

    1. Thanks so much for your concern, I genuinely appreciate that you would worry for me. But that said, I assure you those guys were very professional, gentle, and super nice. They were firm but did not once make me feel any jeopardy. The fault is Delegate Shott’s for having them escort someone out for something like this. Outrageous! Shott should have just let me have my measly 1:45. There are a lot of people who couldn’t travel down there so early in the morning and I was doing my best to speak for them. We’re having a corporate invasion in my district and every damn one of our national representatives—and a good number of our state representatives—are working for the invaders. They spend hours talking to these slimy blackguards, yet won’t come and talk to the people who are being affected by this stuff. We need basic damn services, and they’re wasting time trying to give our property rights away. Our homes and farms are all most of us have in the world of value.

    1. This was a public hearing. So I drove to Charleston on the day, sat outside until they opened the doors, went through security, walked to the chamber, waited for the paperwork to arrive, then signed my name to a list of speakers and waited to be called.

      You can do that for less than two minutes of time, or you can be a lobbyist with a bunch of money who throws a party for them at the Marriott

  5. Lissa’s comments about campaign donations by gas and oil are totally appropriate in addressing HB4268 because our citizens have a right to know any potential influence by donors. That is not personal but PUBLIC information. Anyone who says that breaks the rules makes me suspect they are paid by gas and oil to do so.

  7. If I’ve said it once,I’ve said it a thousand times. People need to voice their opinion on politics,and term limits,and politicians accepting money from big companies. WV.and the U.S.needs to make a clean sweep come election time. Term limits will stop a lot of big business from running our political agenda. It would take a revolution to change things,but we have to start somewhere. If you don’t do anything else in your life,get out ,and vote against these career politicians. If not,you and your children will have to pay the price!

    1. The blame falls squarely on the shoulders of Delegate Shott, for sure. The guards were actually very professional, seemed apologetic, and didn’t hurt me or make me fear. I had chatted with some of them earlier, before the hearing (little thinking!). But please don’t blame them for Delegate Shott’s bad judgment. They don’t get paid nearly enough.

      I really appreciate your concern for my safety, though. It’s tuching to think so many strangers were worried about me.

    1. Seriously! If he’d just allowed me the last 20-some seconds (or however much I had left), I don’t think it would ever have made the papers. It’s not like I’d found new information no one else had ever heard before, something that no one else could find unless I spoke it aloud. It wasn’t deep investigative reporting. It was info based on their own campaign finance reporting.

      It’s like our legislators don’t think things through, hm….

  19. I’m on your side Lisa, i want you to succeed. So one piece of advice, learn the rules of decorum for your chambers! they kicked you out on a technicality (which is what they really are there for).

    Try something like “I think it’s relevant to this bill to investigate the backers of this project. Public information shows tens of thousands of dollars donated by these special interests to the members of this committee..”

    In my state, when they refer to each other, it’s always “the gentleman from the 40th district”, etc. you”’

    1. Thanks for the good advice, and for the kind words.

      Before the hearing started, they gave us a little primer: “no personal attacks” (also things like, “when your name is called, sit here…”). They didn’t say “no names.” If they had—or if Shott had interrupted to explain that the rules require I say “the gentleman from the Xth,”—I could easily have complied. I had the districts written down in my remarks, too.

      I actually wasn’t sure if I’d be able to get everything read out in time, but I intended to stop when my time was called… because believe it or not, I’m sort of a rules-follower.

      But… I have real trouble respecting authority that’s abused. He called it a personal attack, and it was no attack.

      If in fact the issue was that I was using names rather than numbers, I wonder if they’ll improve the instructions for members of the public next time? And to be snarky ( because sometimes I can’t help myself ) my guess is that he probably allows his lobbyist buddies call him John when he’s whisky-ing it up with them. Ha!

    Yes, it was ridiculous of them to throw you out without letting you finish. But honestly, they shot themselves in the leg by doing that. The fact that they threw you out makes people want to know what you were going to say, because obviously they don’t want us to hear it. Good work!!

  23. You, my lady, are the definition of a true patriot. Those other delegates who hate sunlight on their activities are not. They can stand on their head and spit corporate donation quarters in denial, but people like YOU are the ones who make America great and they are the people who make the cesspool we’re all mired in.

    I’ve never heard of you before today (linked from the Huffington Post) but if Dems can get more people like you to run, we can take back this country from some very bad (and enormously greedy) people. I’d love to run but I live in a very blue district in a very blue state and my reps all vote the way I wish they would.

  28. I just found your video on Reddit. We need more people like you to do exactly what you are doing. It takes guts to stand up there and speak the truth.

    This isn’t a partisan issue- Politicians on both sides of the aisle take bribes from lobbyists to pass certain pieces of legislation. And this needs to end, period. Our country and our states are not for sale. This is not a game of monopoly. If you’re rich, buy a yacht. Buy a mansion. Buy a private island. But don’t try to buy my government.
